Adding Some Pizzazz

Well, it seems I've been neglecting my posting, very much like I've been neglecting writing in my journals. Bad. Normally I start off with some insightful thing about the law or law school and then I go into my flavor of the week. Though, for some reason I feel like Constitutional Law is quite a bore to the majority of people. Admittedly, I'm not quite a fan myself, but I've come to appreciate the intricacies of judicial opinions and "standing." I say standing because that is the only concept I remember from class.

Basically, standing has to do with a person having the capability of bringing a suit into the court - that means that they are allowed to bring the case into court. The person doing the suing is called the plaintiff. In order to be considered "proper plaintiffs" a person must have standing. In order to have standing to sue, the plaintiff must meet the following three (prong) test: (1) they must have suffered an injury in fact - that means that they must have actually suffered an injury; (2) be able to show causation - that there is a relationship between the injury and conduct of the defendant (the defendant is the person being sued); and (3) redressibility - there must be a remedy or a way to fix the situation.

So, I'm going to relate this to my "flavor of the week." Vonsa is the owner of a store called "Cup of the Mornin'." Cup of the Mornin' is well known for its awesome tea cups. Let's say Vonsa sues Bilow because Bilow stole a bunch of her tea cups one night. This is a civil case, not a criminal case. A criminal case is different than a civil case because Civil Cases are brought by private parties against other parties whereas a Criminal Case is one that is brought by the state against a defendant - the "bad" guy. So Vonsa is a private person suing another private person for damages because Bilow stole an antique $15,000 tea cup and it was lost forever and ever....

Does she have standing? Well, let's look at the three things I told you previously.
1. Did Vonsa suffer an injury? Yes; she lost a $15,000 cup.
2. Was there causation? Yes; Bilow stole the cup, therefore his stealing caused her injury.
3. Is there redressibility? Yes; the court can award her money!

Done.

Now onto more exciting things - especially since I am watching the 10 o'clock news and it's making me very sad. Society has really become a tragic display of people's worst charactertraits - rapists in broad daylight, crazy people pushing old ladies to their death....





I've become sort of a tea junkie. The other day I bought an assorted set of Bigelow tea. Today I tried Pomegranate Pizzazz and it was yummy! It felt like little berries were bursting onto my tongue. Though, to be honest with you...Orange and Spice is my favorite. It kind of comes at you like a swirl of happiness! It has a hint of sweetness and a rush of tang. I very much enjoyed it and I think you should go out and try it too!!

Another thing that I seem to have discovered is that TARGET - yes, TARGET - sells Salon Quality Shampoo at a almost less than Salon price!

I bought Tigi Moisture Maniac for $12 - and it comes in sets of 2 for one. That means I paid only $6 per bottle. It smells like an explosion of citrus! I've caught myself swirling my hair and flipping it just to catch a glimpse!

There's also this bumble and bumble TONIC lotion that works wonders on my hair. Lately it's been a hot mess of tangles. I even had to dye my hair brown because I don't have time to maintain my roots. Yes world, I was not a natural blond. Target sells the STYLE lotion, which actually works well with heat, but the TONIC LOTION makes your hair feel like a bunny rabbit's fur. :)

Off I go to drink more tea! I'm on my 3rd cup!
